Participant Release and Waiver of Liability Form 

This Release and Waiver of Liability (the “release”) executed on the date this form is completed by the participant ("Participant") who completes this form releases Falmouth Land Trust, a nonprofit corporation existing under the laws of the State of Maine, and each of their directors, officers, employees, and agents. The Participant desires to participate in Falmouth Land Trust programming. Participant understands that the scope of Participant’s relationship with Falmouth Land Trust is limited to a participant position and that no compensation is expected in return for participating in programming; that Falmouth Land Trust will not provide any benefits traditionally associated with employment to Participant; and that Participant is responsible for his/her own insurance coverage in the event of personal injury or illness as a result of Participant’s involvement in Falmouth Land Trust programming.

Waiver and Release: I, the Participant, release and forever discharge and hold harmless Falmouth Land Trust and their successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arises or may hereafter arise from my participation in Falmouth Land Trust programming. I understand and acknowledge that this Release discharges Falmouth Land Trust from any liability or claim that I may have against Falmouth Land Trust with respect to bodily injury, personal injury, illness, death, or property damage that may result from participation in Falmouth Land Trust programming

Insurance: Further, I understand that Falmouth Land Trust does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health or disability benefits or insurance of any nature in the event of my injury, illness, death or damage to my property. I expressly waive any such claim for compensation or liability on the part of Falmouth Land Trust beyond what may be offered freely by Falmouth Land Trust in the event of such injury or medical expenses incurred by me.

Medical Treatment: I hereby Release and forever discharge Falmouth Land Trust from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a participant in Falmouth Land Trust programming.

Assumption of Risk: I understand that participating in Falmouth Land Trust programming may include inherently dangerous activities that may be hazardous to me, including, but not limited to, hiking, walking, trail running, mountain biking, and nature exploration in remote wilderness settings in uneven terrain. As a participant, I hereby expressly assume the risk of injury or harm from these activities and release Falmouth Land Trust from all liability for injury, illness, death, or property damage resulting from participation in programming.

Photographic Release: I grant and convey to Falmouth Land Trust all rights, title, and interests in any and all photographs, images, video, or audio recordings of me or my likeness or voice made by Falmouth Land Trust in connection with my participation in Falmouth Land Trust programming.

Minors: Minors under the age of 18 are required to be accompanied by a legal guardian.

Parking: I understand that I am parking at my own risk during Falmouth Land Trust events and hold harmless any parking area owners, managers, and/or management companies.

Other: As a participant, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Maine and that this Release shall be governed by and interpreted in accordance with the laws of the State of Maine. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
